Spain: Council of Ministers approves Agency for the Supervision of AI

On August 22, 2023, the Ministry of Finance and Public Function announced the approval by the Council of Ministers of a Royal Decree approving the statute for the creation of the National Artificial Intelligence Supervisory Agency. In particular, the press release highlights that the Agency's creation is reflective of the Digital Agenda 2026, which includes a National Artificial Intelligence Strategy which seeks to offer a framework for the development of 'inclusive, sustainable, citizen-focused' artificial intelligence (AI).

More specifically, the press release notes that the Agency is attached to the Ministry of Economic Affairs and Digital Transformation through the Secretary of State for Digitization and Artificial Intelligence. Furthermore, the press release notes that the Agency is the first AI-specific body in Europe, aiming to anticipate the Proposal for a Regulation of the European Parliament and of the Council Laying Down Harmonised Rules on Artificial Intelligence (the AI Act) which requires the selection of a national supervisory authority for AI.
